How does Pearland approve an ADU?
Through a conditional use permit. As of October 2026, an ADU in Pearland needs a CUP: the Planning and Zoning Commission makes a recommendation and City Council decides. That makes Pearland the slowest and least predictable of the cities we serve.
What happened to Pearland ADU requests in 2026?
Community Impact reported two denials. In February, council denied a CUP in the Green Tee Terrace neighborhood after the commission had recommended approval 4 to 2, citing concern about future rental to non-family members. On May 11, council unanimously denied a CUP for an 1,856 sq ft ADU on a one-acre lot, though the commission had recommended approval 5 to 1. One council member suggested replatting into two lots instead.

Is Pearland changing its ADU rules?
Possibly. The commission and council scheduled a joint workshop on May 18, 2026, to discuss rewriting the unified development code with a focus on ADU rules. As of October 2026, we check for any adopted change before we file.
What improves the odds of approval?
- A clear use. Council concerns have centered on rental, so a family-use application needs to say so plainly.
- A modest size. The May denial involved a unit council described as two full homes.
- Neighborhood rules first. HOA approval, where required, should be settled before the public hearing.
Should I apply for a CUP or replat?
It depends on your lot and goals. On a large lot, splitting into two lots for two homes may be a cleaner path than an ADU. On a typical subdivision lot, a small family suite is the more realistic application. We look at both before you spend money on plans.
